10 Important Facts You Should Know

  1. When selecting an attorney to represent you, it is recommended that you retain one who has experience in the court of the county in which you were cited. My office only represents people who are charged with DUI or other DMV matters in Mendocino and Lake Counties. I am the one who will be in court for you, I live and work here and have been doing exclusively this kind of work since 1992. I have been an attorney continuously since 1978. Who is representing you before the court and DMV is the most intregal part of your defense. Look for DUI and DMV specialists, not the general criminal law specialist. Also, you should be aware that some attorneys advertise with local numbers although that phone rings in distant counties. Finally, be suspicious of unsolicited letters from attorneys.

  2. Contact my office for a free consultation or referral.

  3. Contact DMV Driver Safety in San Francisco within 10 days of your arrest at 415-557-1170 or 1173. Request an administrative hearing to challenge your impending license suspension. If you do not do this, you will give up your right to a hearing. Note the time and date you called and the worker's name. Or, my office can do this for you as part of my free initial consultation .

  4. Record the events of the day you were arrested from the time you awoke until the time you were released from custody. Include all the food and alcohol consumed.

  5. Prepare a detailed medical statement including all regular medications, all over the counter meds you usually take, and any meds you consumed on the day of your arrest. Include any disabilities, diseases or conditions and possible witnesses.

  6. Prepare a detailed statement describing the type of work you do.

  7. Do not talk to anyone but your attorney about the events of that day.

  8. Do not pay any bill for emergency response costs that you may receive in the mail until you talk to an attorney. Some of these bills are illegal and charge for the privilege of being arrested.

  9. Is the attorney you contact the attorney who will be handling your case? Find out the experience of the attorney who will actually represent you in court and before the DMV. Also, be aware that some out-of-area law firms solicit by mail or advertise they practice in an area , but then they hire a local, nearby attorney to represent you.

  10. Retain an attorney who charges a reasonable fee for their experience.
